Enforcement of a judgement from a court or tribunal is a critical stage for a creditor, especially when the debtor fails to voluntarily comply. The process in Ontario can be complex and requires a thorough understanding of the legal procedures and challenges involved. The Rules of Small Claims Court provide a framework for various enforcement mechanisms, such as writs of possession, seizure and sale, and garnishment proceedings.

Most orders issued by a court or tribunal that you have received an order for a monetary amount can be enforced. 


You have 6 years from the date the order is made before you can no longer enforce it. If you are unsure if it is still enforceable, make an appointment for a consultation with LLS, in very rare circumstances, a motion may be able to be filed to have the enforcement issued later.
