Your human rights are defined by our personal characteristics: race, disability, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity, gender expression, age, marital status, family status, etc. These same traits which make individuals unique are the same things which may cause discrimination in your life. If you feel you are being discriminated against, you understand it is humiliating, frustrating, and makes you feel powerless. You dread going ahead with your daily activities to face a seemingly endless cycle of discrimination. Common areas for discrimination are, contracts, employment, accommodation (housing), and memberships in trade and vocational associations.
There is a wide range of remedies available through the HRTO. Aside from damages resulting from loss of dignity, feelings, and self-respect, you could also receive an order for the respondent to undergo training about human rights, or implement workplace policies, or any other number of things the tribunal sees fit for the situation. The tribunal has the power and flexibility to right the wrong for the applicant.
DOCUMENT, DOCUMENT, DOCUMENT.....HRTO is a high stress and very emotional tribunal. It's easy to get away from the facts and get lost in the emotional side of what your going through, which is why documentation of the events and details surrounding each event is so important.
You have one (1) year from the date of the incident to file an application with the HRTO. If there were more than one incident that occurred, you have one (1) year from the date of the last incident.
